Understanding the Ins and Outs of an Uncontested Divorce

Although fairly simple to pursue an uncontested divorce, there are requirements that must be met.

These requirements include:

  • At least one spouse has lived in Florida for a minimum of six months
  • The wife is not pregnant
  • No children under the age of 18
  • Both parties are in agreement on property and debt division
  • Both parties agree that the marriage is broken
  • Neither party is requesting spousal support

If the couple is eligible, they are then able to complete and file the necessary paperwork. This includes a "Petition for Simplified Dissolution," a "Final Judgment of Simplified Dissolution of Marriage," and written arrangements for property and debt division.

Submission of these documents will lead to a court hearing. The judge will verify that the requirements are met and grant approval of the paperwork. If a marital settlement agreement has not been signed, both parties are required to speak their piece, the judge will consent, and the divorce is final.
