Although fairly simple to pursue an uncontested divorce, there are requirements
that must be met.
These requirements include:
- At least one spouse has lived in Florida for a minimum of six months
- The wife is not pregnant
- No children under the age of 18
- Both parties are in agreement on property and debt division
- Both parties agree that the marriage is broken
- Neither party is requesting spousal support
If the couple is eligible, they are then able to complete and file the
necessary paperwork. This includes a "Petition for Simplified Dissolution,"
a "Final Judgment of Simplified Dissolution of Marriage," and
written arrangements for property and debt division.
Submission of these documents will lead to a court hearing. The judge will
verify that the requirements are met and grant approval of the paperwork.
If a marital settlement agreement has not been signed, both parties are
required to speak their piece, the judge will consent, and the divorce is final.
